Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Qstudio (LEE TAEHYEON) (이태현), a sole proprietorship registered under the laws of the Republic of Korea ("Pattern Grader," "we," "us," or "our"), governing your access to and use of the Pattern Grader website at patterngrader.com and all related services (the "Service").
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are an EU, EEA, or UK consumer, nothing in these Terms limits or excludes any mandatory consumer rights you have under the laws of your country of residence. If you are a Korean consumer, these Terms are subject to the Act on Regulation of Terms and Conditions (약관의 규제에 관한 법률) and the Act on Consumer Protection in Electronic Commerce (전자상거래 등에서의 소비자보호에 관한 법률).
1. Definitions
"Account" means a user account registered on the Service.
"Content" means any data, text, grading rules, measurements, patterns, or other materials that you upload, create, or generate through the Service.
"Free Plan" means the unpaid tier of the Service with limited features.
"Merchant of Record" or "MoR" means Polar Software Inc., the entity that processes payments, collects applicable taxes (including VAT, GST, and sales tax), and serves as the seller of record for paid subscriptions.
"Pro Plan" means a paid subscription tier providing access to all Service features.
"Reverse Trial" means the initial 7-day period during which new accounts receive Pro Plan features at no cost, after which the account automatically downgrades to the Free Plan.
"Subscription Period" means the recurring billing interval (monthly or annual) for a Pro Plan.
2. Eligibility and Account Terms
2.1 Age requirement. You must be at least 16 years old to use the Service. If you are under 18, you represent that you have your parent or legal guardian's consent. We do not knowingly collect personal information from anyone under 16. If you are under 16, please do not use the Service.
2.2 Account registration. You may register using Google OAuth or email magic link authentication. You are responsible for maintaining the security of your account credentials and for all activity under your account.
2.3 Accurate information. You must provide accurate, current, and complete information during registration and keep it updated.
2.4 One account per person. Each individual may maintain only one account. We reserve the right to merge or terminate duplicate accounts.
2.5 Account termination by us. We may suspend or terminate your account if you: (a) violate these Terms; (b) engage in fraudulent or illegal activity; (c) abuse the Service or interfere with other users; or (d) fail to pay applicable fees after notice. We will provide reasonable notice before termination except where immediate action is necessary to prevent harm. For Korean consumers, we will provide at least 30 days' notice before termination for causes other than fraud or illegality, in accordance with 전자상거래법.
2.6 Account deletion by you. You may delete your account at any time through your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, subject to any legal retention obligations. If you have an active paid subscription, please cancel it before deleting your account.
3. Service Description and Reverse Trial
3.1 What Pattern Grader does. Pattern Grader is a SaaS pattern grading calculator designed for independent fashion designers. The Service allows you to create, manage, and calculate pattern grading rules.
3.2 The 7-day Reverse Trial. When you create a new account, you automatically receive access to all Pro Plan features for 7 calendar days at no cost (the "Reverse Trial"). At the end of the Reverse Trial, your account automatically downgrades to the Free Plan. You will not be charged. No payment information is collected during the Reverse Trial. This is not a "free trial" that converts to a paid subscription—it is a courtesy preview of Pro features. You may upgrade to a Pro Plan at any time during or after the Reverse Trial.
3.3 Free Plan. The Free Plan provides limited access to the Service as described on our pricing page. Free Plan features may change at our discretion with reasonable notice.
3.4 Service availability. We strive to maintain high uptime but do not guarantee uninterrupted access. The Service is provided over the internet and is subject to interruptions beyond our control.
4. Subscription Plans, Billing, and Auto-Renewal
4.1 Pro Plan pricing.
- Monthly Plan: $12.00 USD per month, billed monthly.
- Annual Plan: $99.00 USD per year, billed annually.
All prices are in US Dollars. Applicable taxes (VAT, GST, sales tax) are calculated and collected by our Merchant of Record, Polar Software Inc., based on your location.
4.2 Merchant of Record. All payments for the Service are processed by Polar Software Inc. ("Polar"), which acts as the Merchant of Record. When you purchase a Pro Plan, your purchase agreement for payment purposes is with Polar. Polar is responsible for payment processing, tax collection and remittance, and issuing invoices and receipts. Polar's terms of service apply to payment transactions. For consumer protection purposes under Korean law (전자상거래법 §18(11)), both Pattern Grader and Polar bear joint responsibility (연대 책임) for refund obligations.
4.3 Auto-renewal disclosure and consent. Pro Plan subscriptions renew automatically at the end of each Subscription Period at the then-current price unless you cancel before the renewal date.
By subscribing to a Pro Plan, you expressly consent to the following automatic renewal terms:
- Your subscription will automatically renew for successive periods of the same duration (monthly or annual) unless you cancel.
- Your payment method will be charged the applicable subscription fee at the beginning of each renewal period.
- You may cancel your subscription at any time through your account settings on the Service (the same medium through which you subscribed).
- Cancellation takes effect at the end of your current Subscription Period—you retain access until then.
This express consent disclosure is provided in compliance with the California Automatic Renewal Law (Cal. Bus. & Prof. Code §§17600–17606, as amended by AB 2863). We retain verification of your consent for at least three years or one year after contract termination, whichever is longer.
4.4 Post-purchase confirmation. After subscribing, you will receive a confirmation email from Polar containing: the subscription plan and price, the renewal date and frequency, cancellation instructions, and a link to manage your subscription.
4.5 Annual renewal reminder. If you have an annual Pro Plan, we will send you a reminder email at least 30 days before your annual renewal date, informing you of: the upcoming renewal date, the renewal price, and how to cancel if you do not wish to renew.
4.6 Price changes. We may change subscription prices with at least 30 days' advance written notice. Price changes take effect at the start of your next Subscription Period following the notice. If you do not agree with a price change, you may cancel before the change takes effect.
4.7 Cancellation method. You may cancel your subscription at any time through your account settings on the Service. The cancellation process is available online—the same medium through which you subscribed. During the cancellation process, we may present one optional retention offer. Immediately adjacent to any such offer, a clearly labeled option to complete cancellation (the "cancel" or "confirm cancellation" button) will be displayed. You will never be required to call, email, or use any offline method to cancel.
4.8 Payment failures. If a renewal payment fails, we may retry the charge and/or notify you to update your payment information. If payment is not received within a reasonable period, your subscription may be downgraded to the Free Plan.
5. Cancellation and Refund Policy
This section sets out your cancellation and refund rights. Different rights apply depending on your location. Where applicable law provides greater rights than those stated here, the applicable law prevails.
5.1 Common provisions (all users)
When you cancel a Pro Plan subscription:
- You retain access to Pro features until the end of your current paid Subscription Period.
- Auto-renewal stops, and you will not be charged for subsequent periods.
- At the end of the current Subscription Period, your account downgrades to the Free Plan.
- Your Content remains accessible under the Free Plan's limitations.
5.2 EU, EEA, and UK consumers — 14-day right of withdrawal
If you are a consumer habitually resident in the EU, EEA, or UK, you have the right to withdraw from your subscription within 14 calendar days of purchase without giving any reason, in accordance with the Consumer Rights Directive (2011/83/EU), Art. 9.
To exercise your right of withdrawal: Send us a clear statement of your decision to withdraw (by email to support@patterngrader.com or through the withdrawal function in your account settings). You may use the Model Withdrawal Form (available at /withdrawal-form), but it is not mandatory.
Effects of withdrawal:
- We will reimburse you within 14 days of receiving your withdrawal notice (Art. 13(1)).
- If you used the Service during the withdrawal period, we may deduct an amount proportional to the service provided up to the time you communicated your withdrawal, compared to the full contract period (Art. 14(3)).
- Refunds are processed through the original payment method via Polar.

5.3 Korean consumers (한국 소비자) — 7-day withdrawal right
대한민국에 거주하는 소비자는 전자상거래 등에서의 소비자보호에 관한 법률에 따라 다음의 권리를 가집니다:
If you are a consumer in the Republic of Korea, you have the right to withdraw from your subscription within 7 calendar days of purchase (전자상거래법 §17), except where an exclusion under §17(2) applies.
Refund processing: Refunds will be processed within 3 business days of your withdrawal notice (§18(2)). No penalty or fee may be imposed for exercising your withdrawal right within the 7-day period (§18(9)).
Annual plan pro-rata refund: For annual subscriptions cancelled after the 7-day withdrawal period, you are entitled to a pro-rata refund for the undelivered portion of the service (가분적 용역), calculated based on the remaining days in your annual Subscription Period.
Joint refund liability: In accordance with 전자상거래법 §18(11), both Pattern Grader and Polar Software Inc. (as the payment processor/대금수령자) bear joint and several liability (연대 책임) for refund obligations.
5.4 Japanese users — refund terms
Japanese law does not provide a statutory cooling-off period for mail-order (通信販売) services under the Specified Commercial Transactions Act. However, under the Consumer Contract Act (消費者契約法) §9, any penalty or cancellation fee that exceeds the average damages caused by cancellation is void.
Pattern Grader does not impose cancellation penalties. If you cancel, you retain access until the end of your current Subscription Period.
5.5 US and California users
No statutory refund obligation applies to digital service subscriptions in the United States. However, if we fail to comply with the California Automatic Renewal Law (Cal. Bus. & Prof. Code §17602–17603), any goods, wares, merchandise, or products provided under the auto-renewal arrangement shall be deemed an unconditional gift to the consumer.
Pattern Grader does not impose cancellation penalties. If you cancel, you retain access until the end of your current Subscription Period.
5.6 Polar refund discretion
Polar, as Merchant of Record, retains discretion to approve refund requests made within 60 days of purchase. Refund requests are subject to Polar's policies, which require a merchant response within 48 hours. Pattern Grader cooperates with Polar to process legitimate refund requests promptly.
5.7 How to request a refund
To request a refund, contact us at support@patterngrader.com or use the refund function in your account settings. Include your account email and reason for the request. We will respond within 48 hours.
6. Japanese Specified Commercial Transactions Act Compliance
For users in Japan, the mandatory disclosures required by the Specified Commercial Transactions Act (特定商取引に関する法律) §11 are provided on our dedicated 特定商取引法に基づく表記 page, accessible from the website footer. The mandatory items required on the final confirmation screen (最終確認画面) under §12の6 — including service details, price, payment method and timing, provision timing, and cancellation terms — are displayed on the checkout page before you confirm your purchase.
7. EU Contract Termination and Withdrawal
For EU consumers, we provide an online withdrawal function accessible through your account settings, in compliance with Directive 2011/83/EU as amended. This function allows you to exercise your right of withdrawal and to cancel ongoing subscriptions through a clear, two-step process: (1) initiate withdrawal or cancellation; (2) confirm your decision. You will receive an automatic email confirmation with the date and time of your withdrawal or cancellation.
For users in Germany, the online cancellation function (Kündigungsbutton) complies with §312k BGB.
8. Intellectual Property
8.1 Our intellectual property. The Service, including its software, design, text, graphics, logos, and branding, is owned by Pattern Grader and protected by copyright, trademark, and other intellectual property laws. These Terms grant you no rights in our intellectual property except the limited license in Section 8.3.
8.2 Your intellectual property. You retain all rights to Content you create or upload through the Service, including your grading rules, measurements, pattern data, and design specifications. Pattern Grader claims no ownership over your Content.
8.3 License from us to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes during the term of your account.
8.4 License from you to us. By uploading Content to the Service, you grant us a limited, non-exclusive, worldwide license to host, store, process, and display your Content solely as necessary to provide and improve the Service. This license terminates when you delete your Content or your account.
8.5 Feedback. If you provide suggestions, ideas, or feedback about the Service, we may use them without restriction or compensation to you.
9. User Responsibilities and Restrictions
9.1 You agree not to: (a) use the Service for any illegal purpose; (b) reverse engineer, decompile, or attempt to extract the source code of the Service; (c) interfere with or disrupt the Service or its infrastructure; (d) access the Service through automated means (bots, scrapers) without our written permission; (e) share your account credentials with others; (f) resell access to the Service without authorization; or (g) use the Service in a manner that infringes any third party's rights.
9.2 You are solely responsible for the Content you create or upload. We do not review or endorse user Content.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any Content will be secure or not lost.
Consumer protection carve-outs: This disclaimer does not exclude or limit any warranties or guarantees that cannot be excluded or limited under applicable law. In particular:
- EU/EEA/UK consumers: You have statutory warranty rights under the Consumer Rights Directive and national consumer protection laws that cannot be waived. This disclaimer does not affect those rights.
- Korean consumers: This disclaimer is subject to the Consumer Protection in Electronic Commerce Act (전자상거래법) and the Act on Regulation of Terms and Conditions (약관규제법). Disclaimers that unreasonably limit the operator's liability are void under 약관규제법 §7.
- Japanese consumers: Under the Consumer Contract Act (消費者契約법) §8, clauses that wholly exclude the operator's liability for breach are void.
11. Limitation of Liability
11.1 Cap on liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATTERN GRADER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES, OUR MAXIMUM LIABILITY SHALL BE $100 USD.
11.2 Exclusion of consequential damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATTERN GRADER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
11.3 Mandatory consumer protection limits. Nothing in this section excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or willful misconduct; or (d) any other liability that cannot be excluded or limited under applicable mandatory law, including EU Unfair Contract Terms Directive (93/13/EEC), Korean 약관규제법 §7, and Japanese Consumer Contract Act §8.
12. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, available at patterngrader.com/privacy. The Privacy Policy describes how we collect, use, store, and share your personal data in compliance with the GDPR, Korean PIPA, Japanese APPI, and California CCPA/CPRA. The Privacy Policy is incorporated into these Terms by reference.
13. Third-Party Services
The Service integrates with third-party services, including Polar (payments), Google (authentication), and email delivery providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services and do not endorse them.
14. Governing Law and Dispute Resolution
14.1 Governing law. These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles.
14.2 Jurisdiction. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Seoul Central District Court (서울중앙지방법원), except as provided below.
14.3 Consumer rights preservation. Nothing in these Terms shall limit or exclude any mandatory consumer rights that you have under the laws of your country of habitual residence that cannot be waived by agreement. If you are an EU, EEA, or UK consumer, you may bring proceedings in the courts of your country of residence in accordance with Regulation (EU) No 1215/2012. If you are a Japanese consumer, you may invoke the mandatory provisions of the Consumer Contract Act in accordance with the Act on General Rules for Application of Laws (法の適用に関する通則法) Art. 11.
14.4 Small claims. Either party may bring individual claims in small claims court in the jurisdiction where you reside, if the claim qualifies under that court's jurisdictional limits.
14.5 Informal resolution. Before initiating any formal dispute, you agree to contact us at support@patterngrader.com and attempt to resolve the dispute informally for at least 30 days.
14.6 No class actions. To the maximum extent permitted by applicable law, disputes must be brought on an individual basis. This clause does not apply where prohibited by applicable mandatory law, including in the EU.
14.7 UN CISG exclusion. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
15. Changes to These Terms
15.1 We may modify these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, by email to your registered address or by a prominent notice on the Service. For Korean consumers, we will provide 30 days' notice in accordance with 전자상거래법 and 약관규제법.
15.2 If you do not agree with the modified Terms, you may cancel your subscription and stop using the Service before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
15.3 Non-material changes (such as correcting typographical errors or updating contact information) may be made without advance notice.
16. Miscellaneous
16.1 Severability. If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
16.2 Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pattern Grader regarding the Service and supersede all prior agreements.
16.3 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
16.4 Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
16.5 Force majeure. We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government actions, power failures, internet outages, or other force majeure events.
16.6 Notices. We will send notices to the email address associated with your account. You may send notices to us at support@patterngrader.com or 244, Surisan-ro, Gunpo-si, Gyeonggi-do, Republic of Korea 15821. Notices are deemed received when sent by email if sent during business hours, or the next business day.
16.7 Language. These Terms are drafted in English, which serves as the reference version. Translations are provided for your convenience. In the event of any inconsistency between the English version and a translated version, the English version shall serve as the reference text, except where applicable mandatory law provides otherwise. In particular:
- EU/EEA/UK consumers: Under the Consumer Rights Directive (Art. 6(7)), you are entitled to receive pre-contractual information in the language of the Member State in which you are habitually resident. Where we provide these Terms in your language, the version in your language shall take precedence to the extent required by applicable mandatory consumer protection law.
- Korean consumers (한국 소비자): 한국어 이용약관이 별도로 제공되는 경우, 약관의 규제에 관한 법률 제3조 제2항에 따라 한국 소비자에 대하여는 한국어 약관이 우선합니다.
- Japanese consumers (日本の消費者): 消費者契約法第3条第1項に基づき、日本語版の利用規約が提供されている場合、日本の消費者に対しては日本語版が優先します。
16.8 Export compliance. You represent that you are not located in a country subject to trade sanctions and are not on any government restricted party list.
